Independence of Justice

The Constitution and law of the Ivory Coast provide for the independence of the judiciary in ordinary criminal cases and civil matters. Under the Constitution and in practice, the judiciary accedes to the executive on political and national security issues. The High Judicial Council, which appoints judges, may reportedly be subject to political interference.

Equal Treatment of Nationals and Foreigners

There have been reports that foreign nationals are not always granted an impartial trial from the country’s judicial system.

Sources of the Law and Legal Similarities

The main source of the law in the country is the new constitution of August 2000. The legal system is based on the French civil law system and customary law. Côte d'Ivoire accepts compulsory ICJ jurisdiction but with reservations.
